PowPowPow Terms of Use

These Terms govern use of PowPowPow, including the website at https://www.powpowpow.com, the public sound bank API, and the PowPowPow iOS app.

Acceptance

By using PowPowPow, you agree to these Terms. If you do not agree, do not use the service.

If you use the iOS app through the Apple App Store, Apple may also require you to accept Apple's standard licensed application end user license agreement or other App Store terms. If these Terms conflict with mandatory Apple terms for App Store distribution, Apple's required terms apply to that conflict.

Service Description

PowPowPow is a soundboard website and iOS app backed by a public sound bank. The website provides legal information, a browsable public sound bank, and a read-only public API for sample sounds. The iOS app can use that public bank where supported.

The current website and public API do not provide user accounts, cloud sync, user uploads, ecommerce, subscriptions, or paid web transactions.

License to Use

We grant you a limited, revocable, non-exclusive, non-transferable license to use PowPowPow for personal or lawful internal use, subject to these Terms and applicable law.

You may not:

  • Copy, modify, reverse engineer, or create derivative works from the app, website, or API except where law allows it.
  • Interfere with, overload, scan, scrape, or attack the service.
  • Use the service to violate law, intellectual property rights, privacy rights, or security controls.
  • Misrepresent that you own, operate, endorse, or are affiliated with PowPowPow.
  • Remove copyright, trademark, license, attribution, or legal notices.
  • Use the service to distribute malware, spam, unlawful content, or harmful automation.

Your Local Content

Any audio or other content you add, use, share, or distribute outside the public sound bank remains your responsibility.

You must have the rights needed to use any audio file, recording, or other material you add to the app. You are responsible for complying with copyright, privacy, publicity, and other applicable laws.

The current service does not receive or host your local app sounds through the website or public API.

Public Sound Bank and External Sources

The public sound bank contains sample sounds and metadata for browsing, streaming, and downloading. Some sound metadata or links may refer to external sources. Third-party sources are controlled by their own terms, licenses, and policies.

Do not assume that any sound is cleared for commercial use, redistribution, broadcasting, sampling, public performance, or other reuse. You are responsible for verifying rights before using any sound outside normal personal app use.

We may add, change, remove, disable, or restrict sounds, metadata, URLs, downloads, API routes, or features at any time.

API Use

The public API is provided for read-only access to public sound bank data and files. We may apply rate limits, change response formats, remove data, or stop API access without notice.

You may not use the API to overload infrastructure, bypass access controls, scrape at abusive scale, or build a confusingly similar service that misrepresents association with PowPowPow.

Intellectual Property

PowPowPow, the website, app, UI, code, branding, and original content are owned by gtktsc or its licensors and are protected by intellectual property laws.

All rights not expressly granted are reserved.

Third-party names, links, app store marks, source references, and sound materials remain the property of their respective owners.

Privacy

Our Privacy Policy explains how information is handled. Use of PowPowPow is also subject to that policy.

App Store Terms

For the iOS app:

  • The app is licensed, not sold.
  • Apple is not responsible for support, maintenance, product claims, legal claims, or intellectual property claims related to PowPowPow except as required by applicable App Store terms.
  • You must use the app only on Apple-branded products that you own or control and as permitted by Apple's usage rules.
  • Apple and Apple's subsidiaries are third-party beneficiaries of the required App Store license terms and may enforce those terms where applicable.

Availability and Changes

PowPowPow is provided as available. We may update, suspend, remove, limit, or discontinue any part of the service at any time.

We do not promise that the service will be uninterrupted, error-free, secure, compatible with every device, or available in every location.

No Professional Advice

PowPowPow is a soundboard and public sound bank service. It does not provide legal, licensing, music clearance, safety, professional, or technical advice.

Disclaimers

To the maximum extent allowed by law, PowPowPow is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.

Nothing in these Terms limits rights that cannot be limited under applicable consumer law.

Limitation of Liability

To the maximum extent allowed by law, gtktsc is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, service interruption, device issues, or unauthorized use of content.

Where liability cannot be excluded, it is limited to the maximum extent allowed by applicable law.

These limits do not exclude liability for intent, gross negligence, death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law.

Indemnity

If allowed by applicable law, you agree to defend and hold harmless gtktsc from claims, damages, losses, liabilities, and expenses arising from:

  • Your misuse of PowPowPow.
  • Your violation of these Terms or law.
  • Audio, files, or other content you use, share, or distribute.
  • Your infringement or alleged infringement of third-party rights.

Termination

We may suspend or terminate access if you violate these Terms, create risk, misuse the API, infringe rights, or harm the service or other users.

You may stop using PowPowPow at any time. Local app data remains controlled by your device and app settings.

Governing Law and Disputes

These Terms are governed by the laws of Poland, without regard to conflict of law rules.

If you are a consumer in the European Union or another jurisdiction with mandatory consumer protection rules, you keep the protection of those mandatory rules.

Courts competent under applicable law will handle disputes. These Terms do not require forced arbitration or waive class or collective rights where such waivers are not enforceable.

Changes to Terms

We may update these Terms when the service, law, or our practices change. The effective date above shows when this version took effect. Continued use after an update means you accept the updated Terms, unless applicable law requires another process.
