Important DMCA Safe Harbor Note

Email-only contact information is not enough by itself to claim U.S. DMCA safe harbor protection. Reporting Copyright Infringement

If you believe material available through PowPowPow infringes your copyright, send a written notice to dmca@gtktsc.com.

Your notice should include:

  • Your physical or electronic signature, or the signature of a person authorized to act for the copyright owner.
  • Identification of the copyrighted work claimed to be infringed. If multiple works are covered by one notice, provide a representative list.
  • Identification of the material claimed to be infringing or the subject of infringing activity, plus information reasonably sufficient for us to locate it, such as a URL, sound ID, API path, file name, or description.
  • Your contact information, including name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that use of the material in the complained-of manner is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.

Incomplete notices may delay review.

Response to Notices

When we receive a notice that appears valid, we may remove, disable, or restrict access to the identified material. We may also forward the notice to the person or source associated with the material, if known.

We may reject notices that are incomplete, abusive, fraudulent, unclear, or not related to copyright.

Counter-Notice

If you believe material was removed or disabled because of mistake or misidentification, you may send a counter-notice to dmca@gtktsc.com.

Your counter-notice should include:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the location where it appeared before removal or disabling.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification.
  • Your name, mailing address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district where your address is located, or if your address is outside the United States, for any judicial district where gtktsc may be found.
  • A statement that you will accept service of process from the person who sent the original notice or that person's agent.

Restoration

If we receive a valid counter-notice, we may forward it to the original complainant. Unless the original complainant tells us that they filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed or disabled material in 10-14 business days after forwarding the counter-notice, where appropriate and permitted by law.

Repeat Infringers

When appropriate, we may terminate or restrict access for users or sources that repeatedly infringe copyrights or repeatedly submit infringing material.

Misrepresentation

Submitting false, misleading, or bad-faith copyright notices or counter-notices may create legal liability, including liability for damages, costs, and attorney fees under 17 U.S.C. Section 512(f) or other applicable law.
